Building Regulations – The Client and Duties

The client has certain duties under building regulations concerning building works, particularly when the works are domestic, meaning not done in connection with a business. The domestic client must appoint a principal contractor and a principal designer under the building regulations. If the domestic client fails to do so, the designer in control of the design phase will automatically become the principal designer, and the contractor in control of the construction phase will automatically become the principal contractor. The responsibilities of the principal contractor and principal designer will transfer to these parties by default. If you are a contractor or designer working for a domestic client, be aware that the duties of a principal designer or principal contractor may fall on you. Ensure that the client has appointed someone else if this is not intended, and that this is noted in your contract. Alternatively, make sure you have accounted for and are prepared to carry out these duties if the client does not appoint another party.
